On all job locations trespassing may be an issue. It is the responsibility of the Guard to ensure that no individual is permitted on the property unless authorized. This would include persons that have been previously asked not to return to the property, persons who have been arrested for offences on the property, as well any individuals that have been dismissed from a company and requested by management that they not return to the property. The Trespass to Property Act fully outlines what constitutes trespassing and who has authority to ban a person from a property as well as who has authority to arrest a person for trespassing.

Cases of trespassing should be treated in the same manner as any other situation while on the job site. The Guard should act in a professional manner with courtesy towards the individual. If an arrest is necessary, then the proper arrest procedures should be followed; however it is usually prudent to allow the individual the opportunity to vacate the premises rather than going through the costly process of apprehending someone on a modest Provincial Statue Offence.
